Yes.  But you cannot sell a copy of it, because you don't have the right to
make copies except for your own use -- if you sell one of those, you have to
destroy the others because you've sold your right to use it.

_If_ you came by that copy legitimately.  You can only have come by that
copy legitimately if you accept the licence agreement.  You can download it
(let us assume you can download the files from a public machine unless it's
explicitly stated otherwise, which is fair enough), and if it says somewhere
prominent (say, LICENSE.TXT or the opening screen of the game) that you
cannot distribute, and you intend to distribute it, you are not agreeing to
the licence, and you have no right to use the software.  If you don't
destroy the copy, you are in possession of an unlicensed copy -- one which
you have not been granted permission to use.  If you accept the licence
agreement, and then later violate it (here, by distributing it), then the
licence is terminated and again you are in possession of an unlicensed copy.
