No, because you signify acceptance of the license by using the software in
most cases.  If you downloaded it and played it, technically you're in
breach of your license, but the clause would probably be too stupid to worth
bothering about.

Besides, the difference between "You may not download this game" and "You
may not sell this game"/"You may not include this game in any compilation
without the author's consent" is rather significant, no?
