Ummm, notice he's coming in from activision.com?  I'd think that someone
who works for the company who made the game would have just about any
rights to it they pleased.  ;)  Or what, Activision's going to take him to
court for trying to get an old copy of an Activision game?

My first reaction to the post was the same as your reaction -- until I
noticed the email address.  Now, I wonder why someone from Activision is
interested in a seven-and-a-half-year-old game?
